What is the court of cassation? and when can a judgment be appealed before it?
The Court of Cassation is regarded as a “court of law,” in contrast to other courts that are “courts of subject matter.” It does not examine the merits of a case, evaluate evidence, or hear witnesses. Its primary role is to ensure that lower courts have applied the law correctly and based their judgments on valid legal reasoning and sufficient evidence.
An appeal to the Court of Cassation is considered an extraordinary remedy, available only for specific legal grounds.
Does a favorable judgment guarantee that I will receive the owed amount during the execution proceedings?
If the judgment requires your opponent to pay you a certain amount, the execution of that judgment and your receipt of the money determine the overall effectiveness of the litigation process.
